Listing Items

ARTWORK POLICY

You may list and sell artwork created by yourself or by other artists, provided that the artwork and listing do not infringe any copyrights, trademarks, design rights, or other intellectual property rights.

Authenticity Requirements

When selling artwork, you should include any available evidence that supports its authenticity. Examples include, but are not limited to:

  • Original of Authenticity (COAs)

  • Purchase invoices or sales receipts

  • Exhibition labels, catalogs, or gallery documentation

  • Artist catalogues raisonnés

  • Professional appraisals

  • Auction house catalogs and records

  • Archival photographs, videos, or related documentation

Any authenticity documentation referenced in the listing must be provided to the buyer upon sale. Sellers may not disclaim responsibility for authenticity claims made within a listing.

Reproductions and Replicas

Authorized reproductions of artwork may be sold on PatriotBuySell if the seller has the necessary rights or permission from the intellectual property owner.

Examples include:

  • Posters

  • Replica paintings

  • Limited-edition prints

  • Sculptures from editioned releases

  • Collectible art toys and similar reproductions

Replica paintings may only be sold when the original artwork is no longer protected by applicable intellectual property laws. Listings for replica paintings must clearly identify the item as a replica in both the title and description.

Use of Artist Names

An artist's name may only be used in a listing when:

  • The artwork was created by that artist; or

  • The item is an authorized reproduction of the artist's work.

Listings for works merely inspired by, influenced by, or created "in the style of" an artist must not use the artist's name in a way that could mislead buyers regarding authorship or affiliation.

Altered, Restored, or Conserved Artwork

If an artwork has been altered, repaired, restored, reframed, cleaned, or subjected to conservation treatment, the listing must clearly disclose the nature and extent of the work performed so that buyers can make informed purchasing decisions.

PBS reserves the right to take action when a listing, image, or account violates this policy. Actions may include:

  • Removal of listings or content

  • Seller warnings

  • Temporary selling restrictions

  • Permanent account suspension

  • Other actions required by law or the PBS User Agreement
